General Release and Waiver of Liability for Participation in a Photoshoot for the Faces of Transplantation Calendar and Annual Report

For and in consideration of being permitted to participate in a photoshoot for the Faces of Transplantation Calendar and Annual Report, I, on behalf of myself, as well as my heirs, personal representatives, guardians, successors, assigns or any persons deriving their claims through me, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify LifeLink Foundation, Inc., LifeLink Legacy Fund, and their owners, agents, officers, employees, parent corporations, affiliates, subsidiaries, successors and assigns (referred to collectively as “LifeLink”) from any and all claims, suits or causes of action of any nature, including claims for negligence, that I have or may have in the future arising from my participation in a photoshoot for the Faces of Transplantation Calendar and Annual Report. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by LifeLink.

I understand that my participating in a photoshoot for the Faces of Transplantation Calendar and Annual Report will or may expose me to risks and dangers, that my participation in a photoshoot for the Faces of Transplantation Calendar could result in my injury or illness, including but not limited to bodily injury, disease (including COVID-19), disability or death, and that these risks and dangers may be caused or increased by the negligence of LifeLink. I assume all risks and dangers and all responsibility for any loss(es) or damage(s) whether caused by LifeLink or any third person.

This Release extends and applies to, and also covers and includes, all unknown, unforeseen, unanticipated, unsuspected and future injuries, damages, loss and liability and the consequences thereof, as well as those now disclosed and known to exist. The provisions of any state, federal, local or territorial law or state providing that releases shall not extend to claims, demands, injuries, or damages which are known to or unsuspected by the person executing such release to exist at this time, are hereby expressly waived.

I agree to indemnify and save and hold harmless LifeLink from any loss, liability, damage, or cost (including attorney’s fees) I may incur due to my participating in a photoshoot for the Faces of Transplantation Calendar and Annual Report whether caused by negligence of LifeLink or otherwise.

I understand fully that by signing this Release I am giving up rights I may have. I have not relied and do not rely upon any representation or statement made by LifeLink with regard to the subject matter, basis, or effect of this Release. I acknowledge that LifeLink would not have agreed to allow me to participate in a photoshoot for the Faces of Transplantation Calendar and Annual Report if this Release was not signed and that LifeLink allowing me to participate in a photoshoot for the Faces of Transplantation Calendar and Annual Report is consideration for this Release.

I HAVE READ THIS RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE LIFELINK FROM ALL PAST AND FUTURE LIABILITY, INCLUDING BUT NOT LIMITED TO LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH, WHETHER CAUSED BY NEGLIGENCE OF LIFELINK OR OTHERWISE.
